BSD When the plaintiff has a clear claim and the accused doesn’t (Bari vs. Shema-Certain vs. Maybe).
In this shiur the Mishnah describes a situation in which a borrowed cow (e.g.) died in the hands of a borrower. The owner claims that it was lent for no money (and thus the user has to pay for it) while the user claims that it was maybe (yes, he said maybe) rented out, and he is exempt. Does the fact that one side is more certain than the other make any difference?
